These Terms & Conditions ("Terms") are a legal agreement between you and Cocky Rooster ("Cocky Rooster," "we," "us," or "our") and govern your use of cocky-rooster.com (the "Site") and the services we offer through it. By using the Site you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
You must be at least 13 to use the Site and at least 18 to place an order, submit a catering request, join our text program, or submit a franchise inquiry. If you use the Site on behalf of a business, you represent that you're authorized to bind it to these Terms.
We grant you a limited, revocable, non-exclusive license to use the Site for personal, non-commercial purposes. You agree not to: copy, scrape, or republish Site content without permission; interfere with the Site's operation or security; use bots or automated tools without our consent; misrepresent who you are; or use the Site for anything unlawful. We may suspend or end your access at any time for violating these Terms.
Online ordering, delivery, and our rewards program are provided through a third-party platform (Appfront) and any delivery partners it uses. Those services are governed by their own terms and privacy policies, which you accept when you use them. Menu items, prices, hours, and availability vary by location and can change without notice. Prices shown online may differ from in-restaurant prices. All orders are subject to acceptance by the restaurant.
Allergens. Our kitchens handle wheat, milk, eggs, soy, and other allergens, and our items are cooked in shared fryers. We can't guarantee any item is free of a particular allergen. If you have an allergy, tell the restaurant before ordering.
Submitting a catering request through the Site is an inquiry, not a confirmed order. A catering order is confirmed only when a Cocky Rooster location confirms it in writing (including by email or text) and any required deposit is paid. We ask for at least 48 hours' notice; large or complex orders may need more. Quoted prices exclude tax, gratuity, delivery, and service fees unless stated otherwise. Deposit, payment, change, and cancellation terms are set out in your confirmation.
This website and the franchise sales information on this site do not constitute an offer to sell a franchise. The offer of a franchise can only be made through the delivery of a Franchise Disclosure Document (FDD). Certain states require that we register the FDD in those states. The communications on this website are not directed by us to residents of any of those states. Moreover, we will not offer or sell franchises in those states until we have registered the franchise (or obtained an applicable exemption from registration) and delivered the FDD to the prospective franchisee in compliance with applicable law.
Information you submit in a franchise inquiry must be accurate. Financial figures, projections, and statements on the Site (including revenue, growth, and investment ranges) are illustrative, are drawn from our FDD or historical results where stated, and are not a guarantee of any result. Your results will depend on many factors, including location, management, and market conditions.
By opting in to Cocky Rooster texts you agree to receive recurring automated marketing and informational messages at the number you provided. Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. If you send us content or tag us on social media (reviews, photos, comments, ideas), you give Cocky Rooster a worldwide, royalty-free, perpetual license to use, reproduce, display, and adapt it in connection with our business, including on the Site and in marketing, with attribution where practical. You confirm you own the content or have permission to share it, that it doesn't violate anyone's rights, and that it isn't unlawful or offensive. We may remove any content at our discretion.
The Site and everything on it — the Cocky Rooster name and logos, "Take Your Wings and Fly," menu names and sauce names, photographs, murals and artwork, text, design, and software — are owned by or licensed to Cocky Rooster and protected by trademark, copyright, and other laws. You may not use our marks or content without our written permission, except as these Terms allow.
The Site links to third-party sites and services (ordering, maps, social media, payment). We don't control them and aren't responsible for their content, terms, or practices.
We work to keep hours, addresses, menus, prices, and location information accurate, but they can change and errors can happen. Confirm details with the restaurant before you rely on them. We may change or discontinue any part of the Site at any time.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, COCKY ROOSTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, COCKY ROOSTER AND ITS OWNERS, FRANCHISEES, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE CLAIM OR $100. SOME STATES DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Cocky Rooster and its owners, franchisees, employees, and service providers from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Site, content you submit, or your violation of these Terms or any law.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Subject to Section 16, any dispute will be brought in the state or federal courts located in [County / City], Virginia, and you consent to their jurisdiction.
Before filing a claim, you agree to contact us (see Section 19) and give us 30 days to try to resolve it informally. [Optional: binding-arbitration and class-action-waiver clause — a business decision to make with counsel]
We may update these Terms at any time by posting the revised version here with a new "last updated" date. Continuing to use the Site after that means you accept the changes.
We want everyone to be able to use the Site, and we work toward WCAG 2.1 AA conformance. If you have trouble accessing any part of it, contact us (see Section 19) and we’ll help.
