1. Who we are and what this policy covers

This Privacy Policy explains how Cocky Rooster ("Cocky Rooster," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit cocky-rooster.com (the "Site"), order from us, sign up for texts or emails, request catering, ask about a franchise, visit one of our restaurants, or otherwise interact with us. It applies to residents of every U.S. state, and it includes the additional disclosures required by state privacy laws in Section 9.

Some Cocky Rooster restaurants are independently owned and operated by franchisees. When a franchisee collects your information directly (for example, at the counter), that franchisee is responsible for it under its own practices. This policy covers information collected through the Site, our marketing programs, and our brand-level systems.

2. Information we collect

Information you give us

• Contact details — name, email address, phone number, and mailing or event address when you fill in a form, join our email or text list, or contact us.
• Catering requests — event date, location, headcount, and what you'd like to order.
• Franchise inquiries — the information in our franchise application, which can include your city, territories of interest, and financial qualifiers such as net worth and liquid capital. We use this only to evaluate and respond to your inquiry.
• Communications — anything you send us by email, text, phone, social media, or a web form, and reviews or photos you share with us or tag us in.
• Orders and loyalty — online ordering and our rewards app are provided by a third-party platform (Appfront). Information you give that platform, including payment details, is collected by it under its own privacy policy. We receive order details, order history, and loyalty activity so we can fulfil your order and run the program.

Information collected automatically

• Device and usage data — IP address, browser and device type, operating system, referring URLs, the pages you view, and how you interact with them.
• Cookies and similar technologies — see Section 4. With your consent we use Google Analytics 4, the Google Ads tag, Google Tag Manager and the Meta (Facebook) Pixel, which set identifiers to measure the Site and our advertising. None of these load until you accept them in the cookie banner; you can change your choice any time via “Cookie settings” in the footer.
• Approximate location — derived from your IP address or, if you allow it, from your device, so we can show the nearest restaurant.

Information from other sources

• Our ordering and loyalty platform, our customer-relationship and messaging platform, social media platforms when you interact with us there, and advertising and analytics partners.

3. How we use information

• To fulfil orders and catering requests, and to respond when you contact us.
• To run our text and email programs you've opted into, and to send transactional messages such as order or request confirmations.
• To evaluate franchise inquiries and communicate with prospective franchisees.
• To operate, secure, and improve the Site and our restaurants, including analytics and testing.
• To advertise Cocky Rooster, including measuring campaigns and showing you ads on other platforms based on your visit to the Site (see Section 4 to opt out).
• To comply with law, enforce our terms, and protect Cocky Rooster, our guests, and our team.

4. Cookies, analytics, and advertising

We and our partners use cookies, pixels, and similar technologies on the Site:

• Google Ads tag measures conversions from our Google advertising and, if you allow it, personalizes ads. Manage this at Google Ads Settings.
• Google Analytics 4 measures traffic and how the Site is used. Google may use the data under its own terms. You can opt out with the Google Analytics opt-out browser add-on and manage ad personalization at Google Ads Settings.
• Meta Pixel lets us measure our Facebook and Instagram advertising and reach people who visited the Site. Meta may use this data under its own policy. You can manage this at Meta Ad Preferences.
• Essential cookies keep the Site working (for example, remembering a form you started).

Your choices. Use the cookie banner when you first visit, or “Cookie settings” in the footer, to accept or reject these tools. Most browsers let you block or delete cookies. You can also opt out of interest-based advertising from many companies at aboutads.info and networkadvertising.org. Blocking cookies may affect how the Site works.

Global Privacy Control. We treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your personal information and of targeted advertising, as required by applicable state law. We do not currently respond to other "Do Not Track" signals, for which there is no accepted standard.

5. Text message (SMS) program

When you opt in to receive texts from Cocky Rooster, you agree to receive recurring automated marketing and informational messages (such as offers, new location announcements, order and catering updates) at the mobile number you provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to cancel; reply HELP for help. Carriers are not liable for delayed or undelivered messages.

We will not share your mobile number or your text-message opt-in consent with third parties or affiliates for their own marketing purposes. Your number is used only to send you the messages you signed up for and is shared only with the platforms that send them on our behalf.

6. Email marketing

If you subscribe, we'll send offers, news, and updates by email. Every marketing email includes an unsubscribe link; you can also opt out by contacting us. We may still send you non-marketing messages about an order, a request, or your account.

7. How we share information

• Service providers that host the Site, send email and texts, run our ordering and loyalty program, store our data, process payments, and provide analytics and advertising services. They may use your information only to provide services to us.
• Cocky Rooster restaurants and franchisees when needed to fulfil an order, a catering request, or a location-specific question.
• Advertising and analytics partners such as Google and Meta, as described in Section 4. Under some state laws this counts as a "sale" or "sharing" of personal information, or "targeted advertising," and you can opt out (see Section 9).
• Legal and safety — to comply with law or a valid legal request, to enforce our terms, or to protect the rights, property, or safety of Cocky Rooster, our guests, or others.
• Business transfers — as part of a merger, acquisition, financing, or sale of assets, subject to this policy.

We do not sell personal information for money.

8. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us information, contact us and we will delete it.

9. Your U.S. state privacy rights

Depending on where you live, you may have the right to:

• Know / access the categories and specific pieces of personal information we have collected about you, where we got it, why we use it, and with whom we share it.
• Correct inaccurate personal information.
• Delete personal information we collected from you, subject to legal exceptions.
• Opt out of the sale or sharing of personal information, of targeted advertising, and of certain profiling.
• Limit the use of sensitive personal information (we do not use sensitive information beyond what is needed to provide our services).
• Port your information in a usable format.
• Appeal a decision we make about your request, and not be discriminated against for exercising your rights.

How to exercise these rights. Contact us using the details in Section 14. Tell us which right you're exercising and the state you live in. We'll verify your identity by matching what you give us against what we already hold; we may ask for more information if needed. An authorized agent may submit a request on your behalf with your written permission. We respond within 45 days (extendable once by 45 days where the law allows). If we deny a request, we'll say why and how to appeal; you may also contact your state attorney general.

Opt out of sale / sharing / targeted advertising. Turn on Global Privacy Control in your browser, use the Google and Meta controls in Section 4, or contact us using the details above.

California

In the last 12 months we have collected these categories of personal information under the CCPA: identifiers; customer records (name, contact details, and for franchise inquiries, financial qualifiers); commercial information (orders, requests); internet and network activity; approximate geolocation; and inferences drawn from the above for advertising. We collect them from the sources and use them for the purposes in Sections 2 and 3. We disclose identifiers, internet activity, and inferences to advertising partners in a way that may be a "sale" or "sharing"; we disclose all categories to service providers for business purposes. We keep information as described in Section 10. California residents may also request, once a year, information about disclosures to third parties for their direct marketing (Civil Code §1798.83); we do not make such disclosures.

Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states

Residents of states with comprehensive privacy laws have the rights listed above to the extent those laws provide them, including the right to appeal. To appeal, reply to our response with "Privacy appeal" in the subject line; we'll respond within the time the law requires.

Nevada

We do not sell covered information as defined by Nevada law. Nevada residents may still submit an opt-out request using the contact details above.

10. How long we keep information

We keep personal information for as long as needed for the purposes in this policy: while you're a subscriber or customer, for as long as a franchise inquiry is active, and afterwards as needed to meet legal, tax, accounting, and dispute-resolution obligations. Analytics and advertising data are kept according to the retention settings of those platforms.

11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, so we can't guarantee absolute security. If you believe your information has been compromised, contact us right away.

12. Third-party sites and services

Online ordering, our rewards app, Google Maps, and social media platforms are operated by others under their own policies. This policy doesn't cover them. In particular, ordering and loyalty are provided by Appfront; please review its privacy policy in the app or at checkout.

13. Changes to this policy

We may update this policy from time to time. We'll post the new version here with a new "last updated" date and, for material changes, give notice on the Site or by email.
